Skudin Surf Inc. ("Skudin Surf," "we," "us," or "our") operates the website located at SkudinSurf.com and its online registration system at booking.skudinsurf.com (together, the "Site"), through which we offer surf camps, lessons, retail goods, and related services at our locations in Long Island and Rockaway Beach, New York.

This Privacy Policy explains what information we collect, how we use and share it, and the choices and rights you have. It applies to information we collect through the Site and in connection with our programs and services. It does not apply to any separately operated website or location, including Skudin Surf American Dream, which maintains its own website and privacy practices.

By using the Site or registering for our programs, you acknowledge the practices described in this Policy.

1. Who This Policy Covers

The Site and our registration system are intended for use by adults (18 years of age or older). Registration for any minor participant must be completed by a parent or legal guardian. The Site is not directed to children, and we do not knowingly permit children to create accounts or submit their own personal information through the Site. See Section 9 (Children's Privacy) for details on how we handle information about minor participants.

2. Information We Collect

a. Information You Provide When You Register

When a parent or guardian registers a participant through booking.skudinsurf.com, we collect:

  • Parent/guardian information: name, email address, and phone number.

  • Participant information: gender, date of birth, age, and weight range.

  • Household address.

  • Emergency contact information that you provide for the participant (such as name and phone number).

  • Program-related responses, including whether the participant has previously attended our programs, and how you heard about us.

  • Self-dismissal preference, including, where elected, a signed self-dismissal authorization.

b. Health and Safety Information

To operate our programs safely and respond appropriately in the event of an incident, we collect limited health- and safety-related information about the participant, including:

  • Whether the participant has medical insurance (a yes/no response only — we do not request or store insurance policy details or numbers).

  • Whether the participant's vaccinations are up to date in accordance with New York State Department of Health requirements (a yes/no response only).

  • Whether the participant has any allergies (with a space to describe them).

  • Whether the participant has any chronic or temporary medical conditions (with a space to describe them).

  • Whether the participant has been hospitalized or undergone surgery (with a space to describe the circumstances).

We use this information solely to support participant safety and medical response, and to administer our programs. We do not use health- or safety-related information for marketing or advertising.

c. Waivers and Releases

We collect the information contained in any waiver, release, or authorization you complete in connection with our programs, including liability waivers, self-dismissal authorizations, and photo/video releases (see Section 8).

d. Payment Information

Payments are processed by our third-party payment processor, Stripe. When you make a payment, your payment card information is collected and processed directly by Stripe under its own terms and privacy policy. We do not have visibility into, and do not store, your full payment card number on our systems. We may receive limited transaction confirmation details (such as that a payment succeeded, and the amount).

e. Information Collected Automatically

When you visit the Site, certain information is collected automatically through cookies and similar technologies, including:

  • Device and browser information, IP address, and general (approximate) location derived from IP address.

  • Pages viewed, links clicked, referring website, and other usage and analytics data.

We use Google Analytics to help us understand how visitors use the Site. See Section 4 (Cookies and Tracking Technologies) for more, including how to opt out.

f. Communications

If you contact us by email or phone, we collect the information you choose to provide and a record of that communication.

3. How We Use Information

We use the information we collect to:

  • Process registrations and bookings, and administer our camps, lessons, and other programs.

  • Operate our programs safely and respond to medical or emergency situations.

  • Process payments through Stripe and maintain transaction records.

  • Communicate with you about your registration, scheduling, and program logistics.

  • Send marketing emails and newsletters where you have subscribed (see Section 6).

  • Operate, maintain, secure, and improve the Site and our services.

  • Comply with our legal, regulatory, tax, insurance, and recordkeeping obligations.

  • Protect the rights, property, and safety of Skudin Surf, our participants, our staff, and others, and establish, exercise, or defend legal claims.

4. Cookies and Tracking Technologies

The Site uses cookies and similar technologies for functionality, to remember your preferences, and for analytics. A cookie consent banner is presented to visitors, and you can manage non-essential cookies through it.

Google Analytics. We use Google Analytics to measure and analyze Site traffic and usage. Google Analytics sets cookies and collects information such as your IP address and how you interact with the Site. You can opt out of Google Analytics across websites by installing the Google Analytics Opt-out Browser Add-on, available at https://tools.google.com/dlpage/gaoptout. For information about Google's practices, see https://policies.google.com/privacy.

You can also set most browsers to refuse or delete cookies; however, some parts of the Site may not function properly without them.

Global Privacy Control / opt-out signals. Where required by law, we treat a recognized browser-based opt-out preference signal (such as Global Privacy Control) as a valid request to opt out of any "sale" or "sharing" of personal information for the browser from which it is received. As described in Section 5, we do not sell personal information.

5. How We Share Information

We do not sell your personal information, and we do not share it with third parties for their own marketing purposes. We disclose information only as described below.

a. Service Providers

We share information with vendors and service providers that perform functions on our behalf, only to the extent needed to provide their services to us. These include:

  • Squarespace | website hosting and related infrastructure for SkudinSurf.com.

  • GoDaddy | domain registration and email hosting for our business email (info@skudinsurf.com).

  • Our registration software | operation of the booking system at booking.skudinsurf.com.

  • Stripe | payment processing.

  • Drip | email marketing and newsletter delivery (see Section 6).

  • Google Analytics | website analytics.

These providers are authorized to use personal information only as necessary to provide services to us and are expected to protect it.

b. Aggregated or De-Identified Information

From time to time, and not on a regular basis, we may share aggregated or de-identified information that does not identify any individual with vendors or sponsors who support our operations (for example, summary attendance or program statistics). We do not share information in a form that identifies you for these purposes.

c. Legal, Safety, and Business Transfers

We may disclose information if we believe in good faith that doing so is necessary to comply with applicable law, regulation, legal process, or governmental request; to enforce our agreements and policies; to protect the safety, rights, or property of any person; or in connection with a merger, acquisition, financing, or sale of all or part of our business.

6. Email and Marketing Communications

We use Drip to manage and send marketing emails and newsletters. When you register or sign up, we sync your name and email address to Drip, along with whether or not you have opted in to marketing communications.

We send marketing emails only to individuals who have subscribed. You can unsubscribe at any time by using the "unsubscribe" link in any marketing email or by contacting us at info@skudinsurf.com. Even if you opt out of marketing, we may still send you non-promotional messages related to your registration, bookings, or our services.

7. Data Retention

We retain personal information for as long as needed to fulfill the purposes described in this Policy, including providing our services, maintaining records of registrations and waivers, and meeting our legal, tax, insurance, and recordkeeping obligations, and then dispose of it in accordance with applicable law.

8. Photography and Video; Media Release

Skudin Surf photographs and records participants and program activities for use in our marketing, promotional, and social media materials. Consent to this use is addressed in the waiver and release completed during registration.

In addition, by entering or being present in our camp, lesson, or program areas, you acknowledge and agree that you (and any minor in your care) may be photographed or recorded, and you grant Skudin Surf Inc. the irrevocable right to use, reproduce, publish, and display such photographs and video in any media now known or later developed, including print, web, and social media for advertising, promotional, and related purposes, without compensation, notice, or further approval. If you do not wish to be photographed or recorded, please notify our staff on site.

9. Children's Privacy

We care about the privacy of the children who participate in our programs.

Registration is always completed by a parent or legal guardian, who provides the participant's information. The Site and registration system are intended for adults and are not directed to children, and we do not knowingly collect personal information directly from children.

We handle information about minor participants consistent with the Children's Online Privacy Protection Act (COPPA) and the New York Child Data Protection Act (N.Y. Gen. Bus. Law § 899-ee et seq.). We collect information about minor participants only as needed to provide and safely operate the programs you register them for, we do not sell that information, and we do not use it for targeted advertising or profiling.

If you believe a child has provided us with personal information directly through the Site without a parent's or guardian's involvement, please contact us at info@skudinsurf.com and we will take appropriate steps to delete it.

10. Data Security

We maintain reasonable administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, use, alteration, or disclosure, consistent with the New York SHIELD Act (N.Y. Gen. Bus. Law §§ 899-aa, 899-bb). Much of the information we collect is held within the systems of the service providers described in Section 5, each of which maintains its own security measures.

No method of transmission or storage is completely secure, however, and we cannot guarantee absolute security. You are responsible for keeping any account credentials confidential.

11. Your Privacy Rights

a. All Visitors

You may contact us at any time at info@skudinsurf.com to ask about the information we hold about you, to request access or correction, to request deletion, or to opt out of marketing.

b. New York Residents

New York residents are protected by New York law, including the SHIELD Act and, for information concerning minors, the New York Child Data Protection Act. We honor the rights and protections those laws provide.

c. California Residents

If you are a California resident, the California Consumer Privacy Act (as amended by the CPRA) provides you the following rights:

  • Right to know/access the categories and specific pieces of personal information we have collected, the sources, the purposes for collecting it, and the categories of third parties to whom we disclose it.

  • Right to delete personal information we have collected from you, subject to legal exceptions.

  • Right to correct inaccurate personal information.

  • Right to opt out of the sale or sharing of personal information. We do not sell or share personal information as those terms are defined under California law.

  • Right to limit use of sensitive personal information. We use sensitive personal information (such as the health- and safety-related information in Section 2(b)) only for the limited operational and safety purposes described in this Policy, which do not require a separate right to limit.

  • Right to non-discrimination for exercising your rights.

Categories of personal information we collect (under California law) include: identifiers (such as name, email, phone, address); customer records information; characteristics such as gender and age; commercial information (such as transactions); internet or other electronic network activity (such as analytics data); approximate geolocation derived from IP address; and sensitive personal information (limited health- and safety-related information). We collect this information for the business purposes described in Section 3 and disclose it to the service providers described in Section 5.

d. Residents of Other States

Residents of other states with comprehensive privacy laws (such as Virginia, Colorado, Connecticut, and others) may have similar rights to access, correct, delete, and obtain a portable copy of their personal information, and to opt out of targeted advertising, sale, or certain profiling. We honor these rights where they apply.

e. How to Exercise Your Rights

To exercise any of these rights, contact us at info@skudinsurf.com. We will take reasonable steps to verify your identity before responding, and we may ask for information to do so. You may use an authorized agent to submit a request on your behalf, subject to verification. If we decline a request, you may, where applicable law provides, appeal that decision by replying to our response. We will not discriminate against you for exercising your rights.

12. Third-Party Links and Services

The Site may contain links to third-party websites and services (including those of our service providers, sponsors, or social media platforms). This Policy does not apply to those third parties, and we are not responsible for their privacy practices. We encourage you to review their privacy policies.

13. Changes to This Policy

We may update this Policy from time to time. When we do, we will revise the "Last Updated" date above. Material changes will be reflected on this page, and your continued use of the Site after an update constitutes acknowledgment of the revised Policy.
